General Terms and Conditions (GTC) of MV Creation

1. Scope of application
These General Terms and Conditions (GTC) apply to all contracts between MV Creation, [Deine Adresse], and the customer in the version valid at the time the contract is concluded.

2. Services
MV Creation offers services in the field of marketing, in particular:

  • Design of print and online media
  • Social media support and strategy development
  • Consulting and implementation of advertising measures
  • Creation and maintenance of websites
  • Concept and strategy development

The detailed description of the respective services can be found in the individual offer or the service description.

3. Conclusion of contract
A contract is concluded when the customer accepts a written offer or places an order. Cost estimates are non-binding and can be adjusted by MV Creation if requirements or general conditions change.

4. Terms of payment

  • All prices are in euros plus the applicable statutory value added tax.
  • Payment shall be made immediately after invoicing without deduction, unless otherwise agreed.
  • For order volumes of € 10,000 or more, payment is made in three installments:
    • 1/3 before the start of work
    • 1/3 halfway through the project term
    • 1/3 after completion of the work

5. Cancellation and reimbursement of cost estimates

  • It is not possible to cancel services that have already been ordered. Work already performed will be invoiced in any case.
  • If a quotation or offer requires extensive planning work and is not accepted, this service may be charged separately.

6. Retention of title and rights of use

  • The created designs, concepts and strategies remain the property of MV Creation until full payment has been received.
  • After full payment, the customer receives the right to use the services provided, unless otherwise agreed.

7. Retainer models (permanent support)
MV Creation offers monthly support models. These are subject to the following regulations:

  • The minimum booking period is 3 months.
  • Billing takes place monthly in advance.
  • Cancellation is possible with one month’s notice to the end of the month.

8. Warranty and liability

  • MV Creation undertakes to carry out the commissioned services properly and professionally.
  • Liability for damages caused by faulty implementation, late delivery or external service providers is excluded, except in cases of gross negligence or intent.

9. Final provisions

  • The law of the Federal Republic of Germany shall apply.
  • The place of jurisdiction is the registered office of MV Creation if the customer is a merchant.
  • Should any provision of these GTC be invalid, this shall not affect the validity of the remaining provisions.
